Government response to the problem
Some time ago we prepared an article “Confusion between Sevimli and Sevimli Dad”. The article noted that the Halal logo on the Sevimli trademark was not issued by AZsert Halal LLC, which has the right to put this mark on a manufacturing enterprise. It was also determined to be a complete intersection with the halal production unit. On the label of sausages sold under the Sevimli trademark, it was noted that the Ansar trademark belongs to the manufacturer of the same name in Kazakhstan.
ADB received an appeal from the Baku regional branch of the SPP. The appeal says: “The appeal was considered due to the discrepancy between the information on the label of sausages with the Sevimli trademark. The Sevimli trademark referred to in circulation is considered an intellectual property right, and the Intellectual Property Agency ensures the protection of this right, prevents their misappropriation and violation of rights related to its use, and takes appropriate measures in this regard. ... “Halal food. There are “General Guidelines” and “Guidelines for Halal Certification Bodies” standards.
It was noted that issues of concern should be addressed to the appropriate authorities.
The State Service for Antimonopoly Control and Supervision of the Consumer Market under the Ministry of Economy also responded to the appeal. We would like to draw your attention to several parts of the letter: Under the Unfair Competition Law, illegal use of a trademark, geographical indications, company name, trademark or other trademark name is considered unfair competition. Documents and materials confirming the illegal use of trademarks that you allegedly used illegally to investigate the issues mentioned in your application, as well as duly certified copies of documents confirming the protection of these trademarks, have not been submitted. Therefore, it was not possible to study the issue from the point of view of antimonopoly legislation. If documents and materials confirming the illegal use of trademarks that you claim are being used illegally, and duly certified copies of documents confirming the protection of these trademarks are submitted to the EBRD under the Ministry of Economy, the issue will be considered accordingly. ...
