In his speeches, the President repeatedly stressed the importance of the development of entrepreneurship and spoke harshly against those who artificially hinder this development.
However, some institutions ignore the president's recommendations. Entrepreneurs usually complain to the tax or other authorities. In Sabail district, it is the Sabail District Energy Supply and Sales Department that harms entrepreneurs and hinders their work. Complaining about this office to Hit.Az, the "Arena" team writes:
“Arena” carries out its activity as a business entity on Nizami Street, Sabail district, Baku. The main activity of the joint-stock company is to lease the administrative building located at the specified address to various legal entities and individuals. Among the tenants are a hotel, cafe, flower shop, hunting society, parking lot, car oil change and washing station, TV studio, editorial offices of several sites, about 10 public associations, Non-Governmental Organizations, Agrarian Research Center of the Republic of AzerbaijanWe can show their servers, tourism companies, companies operating in the field of e-commerce, two shipping companies, a company operating in Azerbaijan "E-Signature", their servers, legal, consulting services.
Arena receives electricity from Azerishig OJSC on a contractual basis from the Sabail District Energy Supply and Sales Department (Subscriber code 10 / 200-028). Payment of electricity used by consumers is regulated by the Resolution of the Cabinet of Ministers of the Republic of Azerbaijan No. 18 on “Rules of Use of Electricity” approved on February 2, 2005. In accordance with the requirements of paragraph 8.14 of the Rules - The consumer (except for household subscribers) must pay for electricity supplied to him during the billing period within one month after the payment document is submitted by the energy supply company.
as well as the suspension of electricity supply to consumers shall be carried out in the manner specified in paragraph 9.13 of the "Rules for the use of electricity" in the cases provided for in paragraph 9.13.
9.13. the energy supply enterprise may suspend the supply of electricity to the consumer in the following cases:
9.13.1. If there is a relevant written request of the consumer (indicating the reason and duration of the suspension of electricity supply);
9.13.2. if the metered bill of electricity supplied by the energy supply enterprise to the consumer is not paid in full within one month after its submission (delivery) to the consumer by the energy supply enterprise;
9.13.3. in case of repair-preventive and emergency works, as well as prevention of fire or gas leakage;
9.13.4. If the relevant contract is not concluded with the energy supply company;
9.13.5. By court decision;
Termination of electricity supply to the consumer is carried out only individually. .Suspension of electricity supply to a consumer who does not pay the cost of electricity on time shall not result in violation of the rights of other consumers who pay the cost of electricity on time.
As can be seen from the "Rules for the use of electricity" of the Cabinet of Ministers of the Republic of Azerbaijan, the suspension of electricity supply to the consumer is only one month after the date of submission of the payment document by the energy supply company - 30 (thirty) daysIt is possible even if the consumer does not pay for the electricity used after 30 days after the warning.
Despite all this, starting from March 2020, Azerishig OJSC Sabail District Energy Supply and Sales Department will provide us with 15 days later if we have 30 days to pay for the electricity used on the payment document submitted between 12-15 of each monthelectricity supply is suspended.Our monthly written and oral appeals to the Sabail District Energy Supply and Sales Department on compliance with the law were ineffective. It is not possible to receive the heads of departments, and when we approach the office to express our remarks, they direct us from the manager to the deputy manager, from there to the sales manager, and from there to an employee who will listen to us and has no authority. 195 days to the hotlineOur repeated appeals have not yielded any results.they just listen to us and hang up their support. Seeing that such a situation is already intolerable, in August 2020 we appealed to the Energy Regulatory Agency of the Ministry of Energy of the Republic of Azerbaijan about these illegalities. Employees of the Baku branch of the agency responded to our complaint and investigated the situation, invited employees of the Sabail Police Department to the area and informed them of their illegal actions, and an act was drawn up. however, representatives of the Sabail Police Department refused to sign the act and withdrew from the area.
The agency sent a letter to Sabail RETSHI on compliance with the law. Seeing that the situation was like this, the management of Sabail RETSHI assured us through the employees of the department that there would be no such illegal cases and asked to withdraw the complaint. Following the withdrawal of our complaint, the following month, in the same scenario, the cases of non-compliance with the requirements of the same law continued as if nothing had happened.
We would like to inform you that these illegalities of Sabail RETSI have caused more than 300,000 manat of actual material damage to the tenants operating in the area over the past year. With just a few facts, you can probably imagine the scene. The owner of the flower shop rented a flower shop for about 70,000 manat due to the illegal blackout (because the flower is a temperature sensitive product, the blackout makes the goods in the refrigerator completely useless for sale)More than 150,000 manat was actually damaged, food was damaged and thrown away.could not stand this repeated situation and had to terminate the lease agreement with market OJSC. Also, the guests who were in the hotel at this time of the situation expressed their dissatisfaction and left the hotel, and so on. We can continue the list of such cases. We do not know what to call this attitude of Sabail RETSI towards us. The President of the Republic of Azerbaijan, Mr. Ilham Aliyev, has always instructed to be sensitive to entrepreneurs and to eliminate artificial barriers against entrepreneurs. however, Sabail RETSHI remains in a position to disobey the law.Finally, we would like to inform you that on April 13, 2021, Arena OJSC was presented with an invoice for payment, on April 22, a warning was sent via Whatsapp (against the law), and on April 26, April, electricity was provided to OJSC. energy is suspended. Contrary to the law, the electricity supply was cut off after 13 days instead of the usual 30 days. We repeatedly appealed to the Energy Regulatory Agency of the Ministry of Energy on April 23. Although the agency's staff drew up a report and sent a letter to Sabail RETSHI stating that the requirements of the law had been complied with, the lighting supply to the Arena was suspended despite the letter.
We hope that the relevant authorities understand that it is necessary to take steps to ensure that the Sabail District Energy Supply and Sales Department of Azerishig OJSC is not a good thing to take action against entrepreneurs and that the Republic of Azerbaijan, which is developing day by day, is strongerwill fall.
